Why standards directly influence operations

Rest hours and fair treatment affect alertness and error susceptibility. It is no coincidence that the most common accidents in shipping are attributed to human error. The EMSA annual statistics have shown for years that fatigue is a significant factor in collisions, groundings and machinery damage. Fatigue, in turn, is directly linked to work and rest hour regulations – that is, to labour standards.

MLC Regulation 2.3 limits maximum working hours to 14 hours in any 24-hour period and 72 hours in any 7-day period. STCW Section A-VIII/1 supplements this with specific requirements for watchkeeping personnel. In practice, compliance is monitored through rest hour records checked during PSC inspections. The Paris MoU records thousands of deficiencies annually in the area of work and rest hours.

What connection exists with safety

Weak standards erode safety culture. The connection is not abstract but measurable. When rest hours are systematically falsified – which does occur in the industry – fatigued people work where alertness is critical: on the bridge, in the engine room, during cargo operations. When complaint channels do not function, crew members do not report safety-relevant defects. When fair treatment is lacking, the willingness to think beyond the minimum standard diminishes.

The ISM Code requires operators to have a Safety Management System that accounts for precisely these interactions. But an SMS on paper is not enough. What counts is whether procedures are followed on board, whether the master genuinely has the authority to stop unsafe work, and whether the crew dares to report problems.

Technical deep-dive: rest hour falsification and its consequences

Rest hour falsification is one of the worst-kept secrets in shipping. Studies by the World Maritime University and the Seafarers International Research Centre in Cardiff have repeatedly shown that actual working hours on many vessels significantly exceed documented hours. The reason is often operational pressure: too few crew for the tasks at hand, tight port schedules and the expectation that maintenance is carried out alongside normal operations.

The consequences are severe. A second engineer who carries out a repair on the auxiliary boiler after a 16-hour shift makes poorer decisions than one who is rested. This applies to every safety-critical activity on board. MAIB investigations in the UK and BSU reports in Germany regularly reference fatigue as a contributing factor in maritime accidents.

For operators, the question is: is the crew strength sufficient for the actual workload? The minimum manning under the Safe Manning Certificate is a regulatory lower limit, not an operational recommendation. Operators who consistently operate at minimum manning risk systematic rest hour violations – with all the legal and safety consequences that entails.

Digital rest hour recording could solve part of the problem. Some operators already use electronic systems that capture work and rest hours in real time and automatically flag deviations. This reduces the incentive for falsification but does not address the underlying problem of undermanning.

Practical implications: standards as a management tool

Labour standards are not merely obligations but also tools. An operator who systematically analyses rest hour data gains valuable information about workload on different vessel types and routes. If a particular vessel or route consistently shows higher working hours, this is a signal for process adjustment – whether through additional crew, better port planning or automation of certain tasks.

The complaint system under MLC Standard A5.1.5 is likewise a diagnostic tool. If no complaints are received, this can mean two things: either everything is running well, or the crew does not dare to report. Distinguishing between the two requires additional indicators – for example, crew satisfaction surveys, which some progressive operators already conduct.

The connection to vetting is direct. SIRE 2.0, the tanker industry inspection system, and RightShip ratings increasingly consider MLC compliance. Operators with a poor record on labour standards risk not only PSC detentions but also restrictions on chartering.

Case context: PSC detentions due to labour standards

The Paris MoU publishes annual detention statistics by deficiency category. MLC-related deficiencies rank amongst the most common reasons for conditions and detentions. Typical observations: missing or incomplete work hour records, failure to meet minimum rest hours, substandard accommodation and missing seafarer employment agreement documents.

A detention costs an operator not merely the immediate port charges and repair costs but also damages the performance score. Under the Paris MoU, high-risk vessels are inspected more frequently, causing further delays and costs. A poor score can result in charterers refusing to accept the vessel.

The lesson is clear: labour standards are not a soft compliance exercise. They are a hard operational factor with direct financial consequences.

Decision framework: positioning labour standards correctly

Operators should view labour standards in three dimensions. First: the regulatory dimension – what does the MLC require, what does PSC check, what does the vetting process expect? Second: the operational dimension – how do standards affect safety, error frequency and crew stability? Third: the economic dimension – what do violations cost in terms of detentions, reputational damage and increased turnover?

Only when all three dimensions are considered together does a complete picture emerge. Operators who view labour standards merely as a compliance obligation miss the operational and economic potential that consistent implementation offers.
